CONDITIONS OF SALE:

This sale is made subject to all unpaid taxes and superior liens or encumbrances of record and assessments, if any, against the said property, and any recorded leases. This sale is also subject to any applicable county land transfer tax, and the successful third party bidder shall be required to make payment for any such county land transfer tax.

The property to be offered pursuant to this Notice of Sale is being offered for sale "AS IS, WHERE IS." THERE ARE NO REPRESENTATIONS OR WARRANTIES relating to the title or to any physical, environmental, health or safety conditions existing in, on, at or relating to the property being offered for sale, and any and all responsibilities or liabilities arising out of or in any way relating to any such condition are expressly disclaimed.

A cash deposit of 5% of the purchase price will be required at the time of the sale. Remote bidding will not be accepted pursuant to North Carolina General Statutes Section 45-21.25 (a). This sale will be held open ten (10) days for upset bids as required by law.

Residential real property with less than 15 rental units, including single-family residential real property: an order for possession of the property may be issued pursuant to G.S. 45-21.29 in favor of the purchaser and against the party or parties in possession by the clerk of superior court of the county in which the property is sold. Any person who occupies the property pursuant to a rental agreement entered into or renewed on or after October 1, 2007, may, after receiving notice of sale, terminate the rental agreement by providing written notice of termination to the landlord, to be effective on a date stated in the notice that is at least 10 days, but not more than 90 days, after the sale date contained in the notice of sale, provided that the mortgagor has not cured the default at the time the tenant provides the notice of termination. Upon termination of a rental agreement, the tenant is liable for rent due under the rental agreement prorated to the effective date of the termination.

PARCEL ONE: That certain lot or parcel of land lying an being in Plymouth Township, Washington County, North Carolina, and described as follows:

Begin at the control corner of the subdivision of Liverman Heights on the south side of the old Roper Road and at the west end of the said subdivision recorded in Map Book 5, Page 4, Public Registry of Washington County, and run thence southeastwardly along the south side of the public road 310 feet to an iron marker, the beginning corner of the lot herein conveyed, thence south 39 degrees west 200 feet to the south side of Lot No. 3, the said line being parallel with and 10 feet west of the eastern line of Lot No. 3, thence with the said back line south 51 degrees east 10 feet to the southeast corner of said Lot No. 3, thence north 39 degrees east 200 feet to the northeast corner of Lot No. 3, thence north 51 degrees west along the south side of said road 10 feet to the beginning corner of the lot herein conveyed, and being the eastern 10 feet of Lot No. 3 of the foregoing subdivision.

The foregoing lot or parcel of land is conveyed subject to those certain restrictive covenants executed by E. H. Liverman and wife, by instrument dated March 2, 1955, and recorded in Book 174, Page 356, Public Registry of Washington County, North Carolina, and reference is hereby made to this instrument for the terms and conditions of the restrictions placed upon said lots.

IT BEING the same property conveyed to Aubrey W. Liverman and wife, Leontine C. Liverman, by Deed from E. H. Liverman and wife, Mary Cahoon Liverman, dated September 15, 1958, and recorded in Book 188, Page 323, Public Registry of Washington County, North Carolina. The said Aubrey W. Liverman departed this life in March, 1986, and by operation of law property passed to his wife, Leontine C. Liverman.

PARCEL TWO: That certain lot or parcel of land lying and being in Plymouth Township, Washington County, North Carolina, and described as follows:

Begin on the north side of the old Plymouth and Roper Public Road at the control marker at the northwest end of Liverman Heights, which said marker is located at the northwest corner of Lot No. 1 of the subdivision and map hereinafter referred to, and running thence along the south side of said road south 51 degrees east 320 feet to the beginning corner of the lot herein conveyed, and thence continuing the same course along the south side of said road 110 feet; thence south 39 degrees west 200 feet; thence north 51 degrees west 110 feet; thence north 39 degrees east 200 feet to the beginning, and being Lot No. 4 of “Liverman Housing Project —Plymouth, N.C.”, map of which is of record in the office of the Register of Deeds of said County and State in Map Book 5, Page 4, to which reference is hereby made a part hereof for the purpose of description.

The foregoing lot is conveyed to the parties of the second part, subject to the restrictive covenants described in that certain instrument executed by E. H. Liverman and wife on the 2nd day of March, 1955, and duly of public record as aforesaid in Book 174, Page 356.

IT BEING the same property conveyed to Aubrey W. Liverman and wife, Leontine C. Liverman by Deed from E. H. Liverman and wife, Mary Cahoon Liverman, dated August 27, 1955, and recorded in Book 174, Page 503, Public Registry of Washington County, North Carolina. The said Aubrey W. Liverman departed this life in March, 1986, and by operation of law property passed to his wife, Leontine C. Liverman.

This conveyance is made together with and subject to legally enforceable easements, restrictions, conditions and rights of way, if any, appearing of record or onsite.

For further description of the foregoing tracts reference is made to that certain deed dated August 24, 2012, from Leontine C. Liverman, widow, and Kay L. Bennett and husband, Raymond T. Bennett, to James Kelvin Ross, and of record in the Office of the Register of Deeds of Washington County.

Subject to easements, restrictions and rights of way of record, and utility lines and rights of way in existence over, under or upon the above-described property.
